Public Act 104-0538, which enacted SB 315, creates the Artificial Intelligence Safety Measures Act. Section 99 says the Act takes effect January 1, 2027.
Section 18 says that, beginning January 1, 2027, a large frontier developer may not develop, deploy, or operate a frontier model in Illinois without a current disclosure statement filed with the Illinois Emergency Management Agency and Office of Homeland Security. Section 15 requires a frontier developer to report a critical safety incident to the Agency and the Attorney General within 72 hours, or within 24 hours to an appropriate authority when there is an imminent risk of death or serious physical injury. Section 15 sets no separate start date, so we read it as applying from the Act’s effective date.
Section 10 says large frontier developers must publish a frontier AI framework beginning January 1, 2028. From January 1, 2028, or 90 days after a developer first qualifies as a large frontier developer, whichever is later, they must also retain an independent third party for an annual compliance audit.
The Act defines a frontier model as a foundation model trained with more than 10^26 integer or floating-point operations. A large frontier developer is one that, together with its affiliates, had more than $500,000,000 in annual gross revenue in the preceding calendar year.
